By accessing or using AutoTracker ("the Service") at autotracker.xyz, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms may be updated at any time without prior notice. Continued use of the Service after changes constitutes acceptance of the updated terms.

2. Description of Service

AutoTracker provides market data, auction history, and portfolio tracking tools for collector and enthusiast vehicles. The Service aggregates publicly available auction data from third-party platforms and presents it for informational purposes only.

3. No Financial or Investment Advice

Nothing on AutoTracker constitutes financial, investment, or professional advice. All data, valuations, price estimates, trends, and recommendations displayed on the Service are for informational and entertainment purposes only. AutoTracker makes no representations or warranties about the accuracy, completeness, or timeliness of any data.

You acknowledge that vehicle values fluctuate and past auction results do not guarantee future performance. Any purchase, sale, or financial decision you make based on information from this Service is solely at your own risk. AutoTracker and BuiltByCure are not liable for any financial losses, damages, or decisions made in reliance on information provided by the Service.

4. Data Accuracy Disclaimer

AutoTracker aggregates data from public sources including Bring a Trailer, Cars & Bids, and PCarMarket. We do not guarantee the accuracy, completeness, or currency of this data. Prices shown are historical auction results and may not reflect current market conditions. AutoTracker assumes no responsibility for errors, omissions, or outdated information in the dataset.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating an account. AutoTracker reserves the right to suspend or terminate accounts that violate these terms or engage in abusive, fraudulent, or harmful behavior.

6. Prohibited Uses

You agree not to: (a) scrape, copy, or redistribute AutoTracker's data or interface without written permission; (b) use the Service for any unlawful purpose; (c) attempt to gain unauthorized access to any part of the Service or its infrastructure; (d) use automated tools, bots, or scripts to access the Service in a manner that places unreasonable load on our systems; (e) resell or commercialize access to data obtained through the Service.

7. Intellectual Property

All content, design, code, branding, and data compilation on AutoTracker is the property of BuiltByCure. Underlying auction data belongs to its respective sources. You may not reproduce, distribute, or create derivative works from AutoTracker's interface or data compilation without express written consent.

8. Third-Party Data and Links

AutoTracker references data from third-party auction platforms. We are not affiliated with, endorsed by, or responsible for these platforms. Links to third-party sites are provided for convenience. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.

9. Limitation of Liability

To the maximum extent permitted by law, AutoTracker and BuiltByCure shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, goodwill, or other intangible losses — resulting from your use of or inability to use the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising from use of the Service shall not exceed the amount you paid to use the Service in the twelve months preceding the claim, or $100, whichever is less.

10. Indemnification

You agree to indemnify, defend, and hold harmless AutoTracker, BuiltByCure, and their operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Privacy

AutoTracker collects basic account information (email, username) and usage data. We do not sell your personal information to third parties. Data is stored securely via Supabase. By using the Service, you consent to the collection and use of information as described. We may contact registered users with service-related communications.

12. Subscription and Payments

Paid features, if offered, are billed in advance. All sales are final. Refunds are issued at our sole discretion. AutoTracker reserves the right to change pricing at any time with notice to active subscribers. Continued use after a price change constitutes acceptance of the new pricing.

13. Termination

AutoTracker reserves the right to suspend or terminate access to the Service at any time, for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Ohio.
